1. Initial provisions
1.1. These terms and conditions shall govern the deliveries of goods ordered through electronic shop of the company Boritex-SK s.r.o.1.2. The business terms and conditions shall be binding for the Customer after he/ she orders goods and after the Seller confirms the order. The order can be cancelled free of charge by telephone, e-mail or fax within 24 hours after received. In case the Customer had already paid for the goods, the money would be returned to the Customer’s account or would be sent by a money order to the Customer’s address within 3 workdays after credited to the Seller’s account.
2. Prices
2.1. The current retail prices are set in EUR incl. VAT.2.2. Company Boritex-SK s.r.o. reserves its right to unilaterally update the prices of the products offered.
2.3. If you make a purchase for more than EUR 200.00 and register your firm, you will be given an opportunity to purchase for wholesale prices. Your registration will be confirmed on the day following the day of the registration and you will be given a discount.
3. Delivery and payment terms
3.1. The goods will be delivered based on an order (registration is obligatory – login name and password) confirmed by the company Boritex-SK s.r.o. by e-mail or by fax. At the same time the Seller undertakes to observe the Act No. 428/2002 Coll. on Personal Data Protection including the Act No. 90/2005 Coll.; the data entered during registration shall not be disclosed to any third party. The Seller undertakes to pack the goods so that the goods would not be damaged.3.2. The delivery term shall be 2-15 workdays depending on the type of goods, payment method and the way of delivery of the goods.
3.3. Cash payment – personally in the shop at Gercenova 6/A, Bratislava. The delivery period shall start lapsing in the moment of making the payment; if the goods are on stock they can be taken immediately.
3.4. In case of a wire transfer based on a pro-forma invoice the delivery period shall be 2-15 workdays and it shall start lapsing on the date of crediting the purchase price to the Seller’s account. In such case the invoice shall include also postage and packing (paragraph 3.5).
3.5. Postage and packing within the Slovak Republic shall be EUR 5.00 in case of an order up to EUR 100.- and free of charge in case of an order over EUR 100.00(this only applies to retail). Postage and packing to the Czech Republic and shall be EUR 13.00 (this only applies to retail). Postage and packing to the states of EU shall be 23.--EUR. Postage and packing to the other´s states shall be 33.--EUR.
3.6. After paying for the ordered goods in cash or by a wire transfer, transport can be secured by a wholesale customer or by the company Boritex-SK s.r.o.; in the latter case the
Customer shall pay for the transport when accepting the goods that have already been paid for.
3.7. The Seller shall send a consignment via Slovenská pošta or a courier within 2-15 workdays after confirming the order depending on the type of the goods ordered. A tax document shall be included in the consignment.
3.8. When making a payment using CardPay (payment by VISA, VISA Electron, MASTERCARD, Maestro and Diners Club cards) and Tatra Pay, the goods delivery period shall start lapsing after the payment is credited to the Seller’s account. The payment shall include postage and packaging (paragraph 3.5) and shall be made only after the Supplier confirms the order and sends a link to the Customer’s e-mail. Such procedure in case of Cardpay and Tatrapay payments is for the Customer’s sake since the Customer only pays for the goods actually on stock.
3.9. The cards specified at Card Pay payment method can be issued by any bank institution worldwide. The first step is to fill in an order form that includes personal data. Such data shall be used exclusively for provision of certain service and shall not be disclosed to any third party or commercially used in any other way. After filling in the order form and after clicking on the button “pay by card or through Tatrabanka” you will receive a link that will redirect you to Tatrabanka internet site, where, in a protected environment, you can enter your card data (card number, CV code and expiration) and confirm the sum in EUR. Consequently you will receive a notification on making a payment successfully.
3.10. In case the Seller cannot deliver the goods in the specified period, it shall immediately inform the Customer. The Seller reserves its right to refuse executing the order if the order data are incomplete or raise doubts about the Customer’s real intent to order goods. The Customer will be informed about such fact by e-mail or by fax.
4. Guarantee and claims
4.1. If the Customer finds out that that the delivery is not complete, that goods have been confused or damaged during transport, the Customer shall be obligated to file a claim no later than within 2 workdays after accepting the delivery to tel. number: 00421 2 63530383, e-mail: boritex@boritex.sk and then to follow instructions of an Boritex-SK s.r.o. employee. Otherwise the delivery will be considered complete and defectless. Any later claims due to incompleteness of the delivery shall not be accepted.4.2. The guarantee period shall be 24 months and it shall start lapsing on the day of the goods delivery. It is necessary to observe the maintenance instruction specified for every material and attached to every product.
4.3. The Customer shall check the materials before processing them; a claim will not be recognised after cutting or otherwise processing the material.
4.4. We are not liable for damage caused by incorrect treatment or usage. The treatment symbols are attached to each type of clothing. In case of a small defect in fabric 10 cm of fabric shall be added or a discount amounting to 10cm of the fabric shall be given and in such case the defect shall not be considered as a claimable defect.
4.5. The Seller shall not be liable for late delivery of goods caused by post or by courier, or for a non-delivery of goods caused by the manufacturer as a result of any restriction or cancellation of distribution rights or by other unpredictable circumstances.
4.6. In no case return the goods by “cash on delivery” service. Such goods shall not be accepted and the claim settlement period will extend. Contact the Seller on tel. number: 00421 2 63530383 and follow its instructions.
